1. Defining the Clean Bill of Lading (UCP 600 Article 27)

Under UCP 600 Article 27:

"A bank will only accept a clean transport document. A clean transport document is one that bears no superimposed clause or notation expressly declaring a defective condition of the goods or their packaging."

What Makes a B/L Claused (Foul)?

  • ❌ "15 cartons crushed and torn."
  • ❌ "Traces of moisture observed on container roof."
  • ❌ "Second-hand wooden pallets with visible mold."
  • ❌ "Goods re-coopered prior to loading."

What Does NOT Make a B/L Claused?

  • ✔️ "Shipper's load, stow, and count (SLAC)."
  • ✔️ "Said to contain 2,000 cartons of cotton apparel."
  • ✔️ "Particulars furnished by shipper; carrier not responsible."

3. UCP 600 Article 20 Signing Requirements for House B/Ls

When presenting a House Bill of Lading to a bank, the signature box must adhere to one of three exact legal formats:

  1. Signed by Carrier Directly:
    • "ABC Line as the Carrier"
  2. Signed by Forwarder as Named Agent for Carrier:
    • "XYZ Logistics as Agent for the Carrier, ABC Line"
  3. Signed by Master of the Vessel or Named Agent for Master:
    • "Capt. J. Smith, Master, or XYZ Logistics as Agent for Master, Capt. J. Smith"

If the forwarder merely signs as "XYZ Logistics, Forwarding Agent" without naming the carrier or stating agency capacity, the bank will reject the document immediately.

Practical Commercial Flow

Managing a House B/L for an American Retailer Program

A US buyer nominates Expeditors International as freight forwarder. Forwarder consolidates cargo and issues House B/L #EXP-2026-990. The signature box reads: "Expeditors International as Agent for the Carrier Ocean Network Express (ONE)." Commercial Officer verifies that this wording satisfies UCP 600 Article 20 and achieves clean bank negotiation.

Factory Real-Life Scenario

Scenario: During heavy monsoon rains, 12 cartons got wet at the container yard, and the shipping line stamped the draft B/L: "12 Cartons Wet and Deformed."

Solution: Commercial team dispatched an emergency packing team to Chattogram Port CY, replaced the 12 wet cartons with fresh outer cartons, and obtained a Clean Bill of Lading.

Impact: Avoided an immediate bank discrepancy rejection on a $140,000 export file.

Commercial Officer Best Practice

Instruct your port transport team to inspect every carton as it is stuffed into the container and immediately reject any dented or wet boxes before the carrier tallies the tally sheet.

Top Beginner Mistakes to Avoid

  • Accepting a House Bill of Lading that does not identify the name of the carrier or indicates the forwarder signed only as "forwarding agent" without carrier authorization.
  • Assuming banks will overlook a handwritten "crushed carton" note on an ocean B/L.

Important Commercial & Trade Terminology (2 Terms)

Claused (Foul) B/L

A transport document bearing an explicit notation by the carrier indicating damaged, wet, or defective goods or packaging.

💡 Note: Never acceptable under UCP 600.
NVOCC

Non-Vessel Operating Common Carrier — a freight forwarder that books ocean space in bulk and issues House Bills of Lading under its own carrier name.

💡 Note: Must sign as carrier under UCP 600.

Suggested Professional Answer:

Under UCP 600 Article 27, a Clean Bill of Lading is one that bears no superimposed clause or notation that expressly declares a defective condition of the goods or packaging. The word "clean" does not need to appear on the B/L, even if the L/C demands a "Clean on Board Bill of Lading."

Frequently Asked Questions (1 FAQs)

Clear, beginner-friendly answers to the most common questions about the Commercial Department.

No, standard clauses such as "Shipper's load, stow, and count" or "Said to contain" do not declare a defective condition and are explicitly accepted under UCP 600 Article 26(b).

Key Takeaways & Summary Points

1Under UCP 600 Article 27, a Clean Bill of Lading is one that bears NO superimposed clause or notation expressly declaring a defective condition of the goods or packaging.
2Any notation such as "cartons wet," "packaging damaged," or "used drums" makes the B/L Claused, resulting in automatic bank document rejection.
3A Master Bill of Lading (MBL) is issued by the ocean shipping line (e.g., Maersk, MSC) directly to the shipper or forwarder.
4A House Bill of Lading (HBL) is issued by an NVOCC / freight forwarder; it is acceptable under UCP 600 Article 20 only if signed by the forwarder as "Carrier" or "Agent for Carrier."
5Pre-printed phrases like "shipper's load and count" or "said to contain" do NOT render a Bill of Lading claused.

Executive Lesson Summary

Securing clean, properly signed Master or House Bills of Lading is essential to meeting UCP 600 standards and ensuring unconditional bank payment.
